There is no way to mc to know if your kernel is patched or not, so mc
takes the safest approach.

You may want to try the latest version of GNU Midnight Commander
(4.6.0-pre1) and enable charset conversion at the compile time.  Note that
the charset conversion is still unfinished - it's not documented and the
interface is not obvious.
